As of Sept. 8, federal contracts awarded and solicitations issued with a period of performance longer than 120 days and a value above $100,000 must include a clause committing the contractor to use E-Verify, the government’s Internet-based electronic employment eligibility verification system.
The U.S. Chamber of Commerce reportedly filed an appeal to an Aug. 25 federal district court decision upholding the E-Verify requirement, but the Fourth Circuit has not yet enjoined the rule pending the appeal.
U.S. Citizenship and Immigration Services in the meantime has issued a guide for federal contractors on E-Verify as well as a guide supplement.
