The Equal Employment Opportunity Commission has issued a notice of proposed rulemaking to conform its Americans with Disabilities Act regulations to the Amendments Act of 2008, and has also issued a question and answer guide to the rule changes.
The EEOC is proposing changes both to the ADA regulation itself and to the Interpretive Guidance which provides further explanation on how the regulation should be interpreted. Some of the answers in the Q&A provide citations to specific sections of the proposed regulation, as well as citations to portions of the current ADA regulation that have not changed as a result of the ADAAA. The proposed rules are expected to be published this week in the Federal Register.
