NLRB Has Public Database for Contested Two-Member Decisions

The National Labor Relations Board has an online database of all contested cases that were decided by a two-member Board, which the U.S. Supreme Court ruled in June had no authority to issue decisions.

The list of cases includes links to original documents and case status updates that will be refreshed daily. From January 2008 to April 2010, the NLRB operated with three of its five seats vacant, and during that period, the two remaining members issued nearly 600 decisions.

Since the Supreme Court ruling, numerous two-member decisions that had been challenged in federal appellate courts have been returned to the NLRB for new consideration, and many of the other two-member cases were closed through compliance, settlement, withdrawal or other means.
