Employee’s Fragrance Free Policy Request Not Unreasonable Given Co-Workers Behavior
An employee’s request for a “fragrance free” workplace policy was reasonable under the Americans with Disabilities Act in light of co-workers mocking her severe allergic reaction to perfume exposure, and their continued behavior of intentionally wearing the perfume known to cause the allergic reaction, a federal court in Ohio decides.
The court also took into consideration the employer’s failure to reprimand the employees for their behavior, however, because the employer was a government entity, it decides that punitive damages for the employee was not recoverable. Core v. Champaign County Board
