“Pregnant Girls” Remark Leads to Discrimination Trial

Pregnant Workers A Gucci buyer who says that she was subjected to a “barrage” of questions about her pregnancy and plans for a leave during a company reorganization, and that the new manager commented “Wow, all these pregnant girls, what are we going to do with all of them?” can proceed to a trial on her unlawful termination claim under the Pregnancy Discrimination Act, a New York federal court decides.

The company had contended that the buyer’s position had been eliminated as part of the company-wide restructuring, but the court finds that the name change of the position did not support a finding that the position was eliminated, and that the position was filled by a non-pregnant employee. The court also points out that a reasonable jury could also infer that the company was “discontent” with the pregnancy because of the “all these pregnant girls” comment. Crisses v. Gucci America, Inc.
