EEOC Outlines How Current Federal Laws May Apply to Victims of Domestic Violence
The Equal Employment Opportunity Commission has issued a publication illustrating how Title VII and the Americans with Disabilities Act may apply to employment situations involving applicants and employees who experience domestic or dating violence, sexual assault, or stalking. (Hawaii law already prohibits discrimination against victims of sexual or domestic violence.)
In addition to pointing out examples of potential Title VII and ADA violations by employers who fail to hire, terminate or retaliate against applicants or employees who have been victimized, the EEOC guidance outlines the legal process for filing claims of discrimination.
