Employees may do charitable volunteer work for employer, provided services are not same as hired to perform, USDOL says.
In another recently released opinion letter, the Wage and Hour Division says that time spent on volunteer activities by employees outside normal working hours would not be considered time worked, as long as the activities are not the same or similar to those the employee is employed to perform.

For unpaid or volunteer interns, coverage as an employee under laws enforced by the Equal Employment Opportunity Commission “likely will turn on whether the intern receives ‘significant remuneration’ in some form, such as a pension, group life insurance, workers’ compensation, or access to professional certifications, says a recently-released EEOC informal discussion letter.
