New and proposed labor laws affect the way employers deal with unionization efforts. For instance, beginning April 30, 2012, most employers will be required to post a notice informing employees of their rights under the National Labor Relations Act, including their right to join or form a union and to engage in strikes, pickets, and other protected activity. Additionally, the National Labor Relations Board recently approved final rules that expedite union elections. The Department of Labor has similarly proposed new “persuader” rules which, if given final approval, will make it more difficult for employers to obtain advice and guidance in opposing unionization.

Join HEC General Counsels Clayton Kamida and Sheri-Ann Lau Clark in a full-day discussion of the proposed pro-union regulations and an overview of approaches to maintaining a union-free workplace. Among the topics to be discussed are:

The purpose of the American Red Cross Adult CPR / AED program is to help participants recognize and respond appropriately to cardiac, breathing and first aid emergencies. The course teaches skills that participants need to know to give immediate care to a suddenly injured or ill person until more advanced medical personnel arrive and take over. All instructors are currently certified in First Aid/CPR/AED, Lifeguarding and Emergency Medical Response.

Learning Objectives for CPR / AED

  • Recognize the signals of a cardiac emergency.
  • Identify the links in the Cardiac Chain of Survival.
  • Describe how to care for a heart attack.
  • List the causes of cardiac arrest.

The quality of employers’ workplace investigations is coming under close scrutiny. In court cases and in union arbitrations, the investigation that led to a challenged employment decision is often a key focus in the case, and considerations include the qualifications of the investigator, the timeliness and thoroughness of the investigation, and the quality of the investigation report.

This training session covers the basic principles of conducting an effective investigation, including interviewing witnesses, taking witness statements, and writing investigation reports. Attendees also participate in a mock investigation, including interviewing witnesses and making decisions about how the investigation should be conducted.

If your company has 50 or more employees, and the applicable family leave laws seem confusing and complex, this program is an opportune time to obtain clarification from the agencies that administer the statutes. The sessions will provide practical requirements of the family leave laws to assist employers with the proper implementation and designations of family leaves.

The program is divided into two parts, with the morning session focused on the Family and Medical Leave Act, and the afternoon session--for companies with 100+ employees--on the Hawaii Family Leave Law. Participants may select half-day or full-day-with-lunch registration options.

Presenting the requirements of the FMLA: Lori Paikuli-Stride and Min Kirk from the U.S. Department of Labor Wage-Hour Division. Ms. Paikuli-Stride has answered questions about the FMLA and interpretations about the law since its inception, and Assistant District Director Kirk has been featured on past programs for HEC covering the updated FMLA rules and enforcement.
