Learn about the Hawaii Supreme Court’s recent decision in BCI Coca-Cola Bottling Co. v. Murakami – a workers’ compensation discrimination case with significant ramifications for employers.  Join attorneys Amanda Jones, Clayton Kamida, and Richard Rand for a lively discussion concerning the new rules which employers must follow when dealing with workers’ compensation claimants on extended absences, and the high bar that the Hawaii Supreme Court has now set for replacing workers compensation claimants. 

About our Speakers:
Amanda M. Jones, Partner, Cades Schutte, LLP
. Amanda represents employers in state and federal trial and appellate courts, in arbitrations and in administrative proceedings before the Equal Employment Opportunity Commission, Hawaii Civil Rights Commission, and the Department of Labor.  She has successfully defended employers against claims of discrimination, harassment, retaliation, and whistleblowing. She has also achieved favorable decisions in union grievance arbitrations. Amanda frequently advises clients on difficult employment matters and compliance issues, provides training to supervisors and employees, and conducts workplace investigations.  She has been ranked in Chambers and Partners USA in the area of Labor and Employment since 2015. She has also been recognized in The Best Lawyers in America© since 2018.  Amanda grew up in Kaneohe and graduated summa cum laude from the William S. Richardson School of Law, where she served as Editor-in-Chief of the University of Hawaii Law Review. Prior to her legal career, Amanda was a news reporter and anchor for the ABC affiliate in Biloxi, Mississippi.

Clayton Kamida,
President and CEO, Hawaii Employers Council.  Prior to joining HEC in 2005, his legal practice focused on representing Hawaii employers in labor and employment matters. He has represented employers in state and federal court, in arbitrations, and in proceedings before the Hawaii Civil Rights Commission, Equal Employment Opportunity Commission, the federal Department of Labor, National Labor Relations Board, Hawaii Labor and Industrial Relations Appeals Board, and other state and federal administrative agencies. He received his undergraduate degree from the University of Michigan, and his law degree from the University of Illinois, magna cum laude.  Clayton currently is a member of the HIOSH Advisory Committee.

Richard Rand, Partner, Marr Jones & Wang.  Richard has practiced labor and employment law in Hawaii for more than 38 years.  He has counseled employers on a wide range of federal and state legal issues including employment claims, wage and hour law, traditional labor law issues, complex labor negotiations and Davis Bacon Act compliance.  Known as an experienced trial lawyer, he has served as lead counsel in jury trials in both federal and state court, in state and federal administrative proceedings, and has argued numerous cases before the United States Court of Appeals for the Ninth Circuit and the Hawaii Appellate Courts.  Richard also represents employers in arbitration and mediation proceedings. He has represented both buyers and sellers in the labor and employment aspects of many major real estate transactions. He negotiates collective bargaining agreements for employers and counsels them on the administration of those agreements.  Richard has been recognized in The Best Lawyers in America as one of Hawaii’s premier employment lawyers. He is also listed in the Chambers USA directory, America’s Leading Lawyers for Business.  He is a graduate of the University of Pennsylvania and Georgetown University Law Center.
