Federal Agencies address Annual Limit Waiver Expiration Issues in Fifteenth FAQ on the Affordable Care Act

On April 29, 2013, the Departments of Labor, Health and Human Services, and Treasury issued a FAQ list addressing Affordable Care Act issues including annual limit waiver expiration dates, provider nondiscrimination provisions, coverage provided to individuals participating in approved clinical trials, and transparency in coverage reporting requirements. The FAQs clarify that changes in a plan or policy year will not impact the annual limit waiver expiration date previously approved by the Department of Health and Human Services for the plan or policy year in effect when the waiver was sought. While waiver recipients can terminate a waiver at any time prior to its approved expiration date, that deadline will not be modified by any subsequent amendment to a plan or policy year. The FAQs also clarify that plans and issuers will be expected to comply with transparency in coverage reporting requirements after their health plans have been certified as ACA-qualified plans for one year.
