USCIS Proposes Changes to Form I-9

Posted Thursday, March 31, 2016 5:30 pm
HEC members have inquired as to the status of the Form I-9, which lists March 31, 2016 as its expiration date.  On March 28, USCIS published a notice in the Federal Register proposing changes to Form I-9 and inviting public comment on those changes between now and April 27, 2016.

The changes proposed, which are intended to reduce technical errors and improve customer ease in completing the form on their computer after downloading it from uscis.gov, include:

  • Validations on certain fields to ensure information is entered correctly;
  • Drop-down lists and calendars;
  • Buttons that will allow users to access the instructions electronically, print the form and clear the form to start over;
  • A quick-response matrix barcode, or QR code, that generates once the form is printed that can be used to streamline audit processes;
  • Requiring employees to provide only other last names used in Section 1, rather than all other names used;
  • Removing the requirement that aliens authorized to work provide both their Form I-94 number and foreign passport information in Section 1;
  • And more.

As we all await the release of the new Form I-9, USCIS instructs that employers must continue to use the current version of the form in the interim.  HEC will inform members as soon as the new Form I-9 is released.
