Maui Apartment Complex Owes Back Wages after DOL Investigation

Piilani Gardens LLC, a Kihei company, will pay back wages to maintenance and landscaping employees after a U.S. Department of Labor investigation revealed that the company had engaged in pay and recordkeeping practices that violated the Fair Labor Standards Act (FLSA).  Investigators with the DOL’s Wage and Hour Division determined that Piilani Gardens LLC, doing business as Piilani Gardens Apartments, paid employees who resided at the complex straight-time rates when they worked overtime, and exceeded legal limits to a credit it claimed toward its payroll obligations for providing housing to employees.

The FLSA requires employers to pay non-exempt employees time-and-one half for overtime hours, which are defined as all hours worked over forty in a workweek.  To resolve the issues that investigators uncovered, the company has agreed to pay $84,136 in overtime back wages to 22 maintenance and landscaping workers.
