
The U.S. Citizen and Immigration Services (USCIS) announced on April 2, 2025, that an updated Form I-9 with an “Edition Date” of 01/20/25 is available for use. This form is valid to use until the expiration date of 05/31/2027. Notable updates include renaming the fourth checkbox in Section 1 to “An alien authorized to work,” revising descriptions of two List B documents in the List of Acceptable Documents, and updating language in the instructions.
Alternatively, employers may use previous Form I-9s with an edition date of 08/01/23 until the applicable expiration dates listed on the form, either 05/31/2027 or 07/31/2026. Employers using the Form I-9 with an expiration date of 07/31/2026 must transition to an updated Form I-9 prior to then.
Current employees with a properly completed Form I-9 on file do not need to complete a new Form I-9 with the updated edition date unless reverification is needed after the applicable expiration date on the Form I-9.
In addition, on April 2, 2025, the USCIS updated its Policy Manual to recognize only male and female biological sexes in compliance with the Defending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government Executive Order. The USCIS will not issue any documentation with a blank sex field or with a sex different than the one indicated on the individual’s birth certificate. Previously, in April 2024, the USCIS allowed a gender identity marker of “X,” which is no longer accepted by the USCIS.
