“New” FMLA Forms Released

On September 4, the U.S. Department of Labor’s (DOL) Wage and Hour Division released updated Family and Medical Leave Act (FMLA) notices and certification forms.  These forms include the Notice of Eligibility, Designation Notice, and Certification of Health Care Provider.  The forms are available on the DOL’s website.

After the previous forms expired on May 31, 2018, the DOL renewed them on a monthly basis pending approval of the new forms by the Office of Management and Budget (OMB).  Fortunately, the only change to the forms is the expiration date in the top right corner is now August 31, 2021.  The forms are otherwise the same.  Employers, however, should ensure they are now using the updated forms.

For Hawaii employers with 100 or more employees, the Hawaii Family Leave Law is also applicable, and you may want to use different forms.  Samples are available for HEC Members here.
