The Equal Employment Opportunity Commission (EEOC) recently settled a sexual harassment lawsuit based on claims by a class of female employees that worked as servers and bartenders at a Waikiki restaurant that has since shuttered its operations.
The lawsuit had alleged that these employees were repeatedly propositioned, groped and grabbed by managers. The suit also claimed that they were subjected to retaliation after complaining about this conduct. The settlement, which does not include any admission of liability on behalf of the restaurant or the staffing company with which it was working, requires the restaurant to pay a total of $350,000 and to implement non-monetary terms, including the posting of a notice, the retention of an Equal Employment Opportunity Consultant to monitor compliance, updating and reissuing the organization's harassment policy, and providing training to managers upon the opening of another Hawaii restaurant during the term of the Consent Decree. The staffing company, which had been contracted to provide human resources services and oversee non-management staff during the relevant period, had previously settled with the EEOC for $150,000 and non-monetary relief, including employee training.
