Hawaii District Court Judge Leslie Kobayashi recently granted several motions for partial summary judgment filed by the Equal Employment Opportunity Commission on behalf of farm workers claiming hostile work environment and disparate treatment based on race and/or national origin, and retaliation against Thai farmworkers working at facilities in California and Hawaii. In so doing, the court reasoned that the evidence showed that managers physically abused and verbally harassed workers by threatening physical harm and deportation, that they discriminated against workers by treating them less favorably than non-Thai workers and targeted them based on stereotypes that they would be easier to exploit, and that they forced Thai workers who complained about work conditions to work harder than non-Thai workers, in addition to threatening them with deportation, harsh conditions, and physical violence after the reports were made.
