Executive Order prohibits Federal Contractors from Retaliating against Applicants and Employees who discuss Pay

To mark "Equal Pay Day" earlier this month, President Obama signed an Executive Order prohibiting federal contractors from discriminating against any employee or applicant who inquires about, discussed, or disclosed employee compensation.  On the same day, the White House also issued a Presidential Memorandum directing the Secretary of Labor to propose a rule within 120 days that would require federal contractors and subcontractors to submit summary data to the DOL on the compensation paid to employees, including data by sex and race.  Requiring the provision of this information will enable the DOL to increase the efficiency of its equal pay enforcement efforts and encourage greater voluntary compliance by employers.
