Hawaii Farm to pay $460,000 for FLSA and MSPA Violations

Published Thursday, April 24, 2014 7:27 pm

Fat Law's Farm Inc. was recently ordered by a federal judge to pay $428,800 in back wage and $31,200 in penalties due to violations of the Fair Labor Standards Act (FLSA) and Migrant and Seasonal Agricultural Worker Protection Act (MSPA).  The farm had paid Laotian workers $5 per hour in cash for seventy-hour work weeks, despite the applicability of the FLSA's minimum wage and overtime requirements.  The farm was also cited for improper housing, safety and health conditions provided to farmworkers.  These conditions violated the Migrant and Seasonal Agricultural Worker Protection Act, which mandates that employers provide safe housing and transportation to farm workers.
