Closing a business presents multiple challenges for employers. One consideration should be compliance with certain notice requirements that must be met prior to closing operations. The federal Worker Readjustment and Retraining Notification Act ("WARN Act") requires covered employers to provide no less than 60 days notice to employees of plant closings and mass layoffs in certain circumstances. Hawaii's s Dislocated Workers Act ("DWA") requires covered employers to provide no less than 60 days notice to employees of a closing, partial closing, divestiture, or relocation outside the State of Hawaii in certain circumstances. In July, HEC invites its members to become more familiar with these laws by providing several resources comparing WARN and DWA requirements and answering questions that frequently arise under these laws.
