Removal of One-Armed Security Guard after Customer Complaint Violated ADA

A jury in Florida recently awarded $35,922 in damages in a case brought by the Equal Employment Opportunity Commission (EEOC) on behalf of a security guard that had lost a limb in a car accident.  After a customer complained that "the company is a joke - you sent me a one-armed security guard," the employer removed the employee from his post and failed to assign him to another one.  At trial, the EEOC argued that this action, which amounted to a termination, violated precedent establishing that reliance on discriminatory customer preferences in making employment decisions does not insulate an employer from liability for discrimination.  In addition to the monetary award, the agency intends to seek injunctive relief and other remedies, including equal employment opportunity training and policy updates.
