The Equal Employment Opportunity Commission has settled a discrimination lawsuit on behalf of a Texas Wal-Mart manager claiming that he was subjected to harassment and discrimination based on age and disability. The manager claimed that he was harassed and bullied by a supervisor, who allegedly called him "old man" and "old food guy" prior to terminating him. The manager also claimed that Wal-Mart refused to engage in the interactive process and failed to provide a reasonable accommodation for his diabetes. After being diagnosed, the employee requested reassignment to a store co-manager or assistant manager position. The EEOC's lawsuit claimed that the company did not engage in the interactive process with him before rejecting his request for reassignment.
While Wal-Mart denied liability, the parties nonetheless settled the case for $150,000 and non-monetary relief including training on the conduct that can constitute age and disability discrimination and an employer's obligations when an employee requests a reasonable accommodation to a disability.
