Understanding and complying with all the requirements of the Family and Medical Leave Act ("FMLA") and Hawaii Family Leave Law ("HFLL") can sometimes be a daunting task, and challenging for employers who already have a lot on their plate. Staying compliant can be even more difficult with the differences and interplay between the two laws. In an effort to streamline the paperwork involved and reduce the operational impacts of managing employee leaves, HEC has tools available to help.
If you have 50 or more employees within a 75-mile radius, your eligible employees may be entitled to 12 weeks of unpaid, job-protected leave under the FMLA. Employers with 100 or more employees are required to provide eligible employees with up to four weeks of job-protected HFLL leave.
Sample FMLA and HFLL forms, including a combined FMLA/HFLL Notice of Eligibility and Rights & Responsibilities, and Designation Notice, and family medical leave policies are found below as well as on the Employment Laws page of the website. A summary highlighting key differences between FMLA and HFLL is also available to help you navigate the two laws.
Feel free to contact any HR Consultant with your questions on these leave entitlements. For those individuals who need a basic understanding, HEC is hosting a seminar, "Family Leave Laws: An Introduction to FMLA and HFLL", on April 28, 2016. More information is forthcoming.
