Draft Forms for ACA Health Coverage Reporting Required by Large Employers, Released by IRS

The IRS published early release drafts of Forms 1094-C (Transmittal of Employer-Provided Health Insurance Offer and Coverage Information Returns) and 1095-C (Employer-Provided Health Insurance Offer and Coverage).  The draft forms 1094-C and Form 1095-C are available at www.irs.gov/pub/irs-dft/f1094c--dft.pdf and www.irs.gov/pub/irs-dft/f1095c--dft.pdf, respectively.
 
For reports on health insurance coverage for the 2016 year, Applicable Large Employers (ALEs) with at least 50 full-time employees, including full-time equivalent employees, must issue Form 1095-C to each full-time employee by January 31, 2017.  ALEs must file Forms 1094-C and 1095-C with the IRS by February 28, 2017, or March 31, 2017 if filing electronically.  ALEs filing 250 or more returns must file the forms electronically.
 
The Draft Form 1094-C deleted "Qualifying Offer Method Transition Relief" as an option for Line 22 Certifications of Eligibility.  This is because such transition relief is no longer available.
 
The Draft Form 1095-C includes two new codes for Line 14, 1J and 1K.  Both codes recognize that employers offer coverage to spouses only when certain conditions are met.
 
  • 1J.  Minimum essential coverage provided minimum value offered to you; minimum essential coverage conditionally offered to your spouse; and minimum essential coverage NOT offered to your dependent(s).
  • 1K.  Minimum essential coverage providing minimum value offered to you; minimum essential coverage conditionally offered to your spouse, and minimum essential coverage offered to your dependent(s).
