Hawaii Car Dealership Sued for Disability Discrimination

The Equal Employment Opportunity Commission (EEOC) has sued Cutter Mazda of Honolulu on behalf of a job applicant with a hearing impairment. In EEOC v. MJC, Inc. and GAC Auto Group Inc., DBA Cutter Mazda of Honolulu, et al, the agency alleges that the applicant was denied employment based on his impairment. Such alleged conduct violates the Americans with Disabilities Act (ADA), which prohibits employers from discriminating due to disability and requires them to provide reasonable accommodation to enable qualified individuals with disabilities to perform the essential functions of the job.

Glory Gervacio Saure, director of the EEOC's Honolulu Local Office said, "Applicants should not be denied a position under the assumption that the individual cannot do the essential functions of the job." The lawsuit seeks back-pay, compensatory and punitive damages on behalf of the applicant, along with injunctive relief to prevent and address disability discrimination from happening in the future.
