Both CVS Caremark Corporation and Best Buy were under investigation by the U.S. Equal Employment Opportunity Commission (EEOC) for using personality tests/assessments during the application process. EEOC found it probable that between 2001 and 2010, both companies’ use of the personality tests/assessment adversely impacted applicants based on race and national origin.
CVS and Best Buy ceased using the tests though both companies did not admit liability. On June 6, 2018, EEOC announced separate conciliation agreements with CVS and Best Buy, and EEOC commended both organizations for their cooperation in resolving the matter. Both companies agreed to employ staff to recruit and monitor the hiring of minorities, develop a comprehensive training program for managers, conduct regular evaluations of its hiring performance, and submit regular reports to the EEOC for several years.
