Federal Contractors: OFCCP May Begin Focused Reviews in FY 2019

In Directive 2018-04 issued on August 10, 2018, the Office of Federal Contract Compliance Programs (OFCCP) announced its intent to begin focused reviews starting in FY 2019.  In the focused review, the OFCCP would conduct a comprehensive review of the contractor’s compliance with a particular law – Executive Order 11246, Section 503 of the Rehabilitation Act of 1973, or Vietnam Era Veterans’ Readjustment Assistance Act of 1974.   For instance, OFCCP’s focused review of Section 503 would include review of policies and practices related to compliance with the particular law; interviews with managers responsible for compliance and employees affected by those policies; evaluation of hiring and compensation data; and an analysis of accommodation requests.

How will contractors be selected for the focused review?  OFCCP plans to use the same neutral selection system used to identify and create OFCCP’s supply and service scheduling list.

Is there a standard procedure for focused reviews?  Standards have not yet been developed, though OFCCP staff have been directed to create and publish standard protocols for the focused reviews.
