The Hawaii Legislature recently passed a new “Pay Secrecy” law, Act 108, which prohibits employers, employment agencies, and their employees or agents from inquiring into a job applicant’s current or prior compensation, and from relying on an applicant’s current/prior compensation to set initial compensation. Employers are permitted, however, to ask a job applicant about his/her expectations regarding compensation and benefits.
