Current Form I-9 Expires August 31

In a few days, the Form I-9, which is used for verifying new hires’ employment eligibility, will be expiring.  What should you do?

The current Form I-9 was released on July 17, 2017, with a stated expiration date of August 31, 2019.  On March 1, 2019, the U.S. Citizenship and Immigration Services (“USCIS”) published a Federal Register notice to invite public comments on the proposed extension of Form I-9 without any changes.  On June 5, USCIS published another Federal Register notice to invite further comments.  The public commenting period closed on July 5.

According to the USCIS I-9 website, “We will publish a new edition of this form soon.  In the meantime, you may file using the 07/17/17 edition.” USCIS has not yet announced whether the “new edition” will reflect changes based on the comments it received or it will simply change the expiration date.
