In honor of Veterans Day last week, the Office of Federal Contract Compliance Programs (“OFCCP”) wants to make sure employers are complying with the Vietnam Era Veteran Readjustment Assistance Act (“VEVRAA”). OFCCP just published the Corporate Scheduling Announcement List (“CSAL”) for VEVRAA Focused Reviews in addition to the first Directive of FY 2020 concerning veterans’ spouses.
CSAL Published for VEVRAA Focused Reviews
The OFCCP just released the list of organizations selected for VEVRAA Focused Reviews. The “FY 2019 CSAL Supplement” is available on the OFCCP’s FOIA Library website, and lists 500 establishments scheduled for a review focused on compliance with VEVRAA. As discussed in a previous news digest article, companies are urged to check the list because OFCCP will no longer send CSAL letters to the listed establishments as they had in the past. Establishments on the list should not wait for a scheduling letter, but should start preparing now.
To help contractors prepare for the upcoming reviews, OFCCP released a new VEVRAA Focused Reviews landing page that includes best practices, answers to frequently asked questions, and other compliance assistance resources.
OFCCP Will Investigate Treatment of Veteran Spouses
OFCCP also published Directive 2020-01, “Spouses of Protected Veterans.” The purpose of the directive is to “ensure that federal contractors are not discriminating against spouses of protected veterans and to provide compliance assistance during compliance evaluations on how contractors can support the families of protected veterans.”
The Directive provides that during compliance evaluations, OFCCP will ask employees (1) whether they are a spouse of a protected veteran, (2) whether they have coworkers who are spouses of protected veterans, and (3) for any observations they have concerning the treatment of spouses of protected veterans. The Directive also offers compliance assistance by providing this sample nondiscrimination policy statement.
