DOL Withdraws 2 Opinion Letters

On February 19, in line with President Biden's regulatory freeze of the rule concerning independent contractor status under the FLSA, the U.S. Department of Labor's Wage and Hour Division ("WHD") withdrew opinion letter FLSA2019-06, which addressed independent contractor status for gig workers.  The WHD also withdrew FLSA2019-10, which stated that time spent in a truck's sleeper berth was not compensable.
