Rescission and Nonenforcement of DOL Rules

On March 11, the U.S. Department of Labor (“DOL”) announced proposals to rescind the Independent Contractor Final Rule (scheduled to take effect May 7, 2021) and the Joint Employer Final Rule (which took effect March 16, 2020).

On March 10, the DOL's Employee Benefits Security Administration announced that it will not enforce recently published final rules on "Financial Factors in Selecting Plan Investments" regarding socially responsible investments and "Fiduciary Duties Regarding Proxy Voting and Shareholder Rights" regarding proxy voting by employee benefit plans.
